Terms and Conditions of Use.
Please read the following booking terms and conditions carefully before making a reservation. By booking a guided hike with us, you agree to be bound by these terms and conditions.
1. Booking and Payment
1.1. Booking Process: To secure your booking, please complete the online booking form and make the required deposit payment.
1.2. Payment: Full payment is required at the time of booking to secure your booking.
1.3. Confirmation: Upon receipt of your booking and payment, we will send you a confirmation email. Your booking is not confirmed until you receive this email.
2. Cancellations and Refunds
2.1. Cancellation by You:
Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your booking within 14 days of receiving your booking confirmation for a full refund. This right does not apply if the hike is scheduled to commence within the 14-day cancellation period.
More than 8 weeks before the hike: Full refund.
4 to 8 weeks before the hike: 50% refund of the total cost.
Less than 4 weeks before the hike: No refund.
2.2. Cancellation by Us: We reserve the right to cancel a hike due to unforeseen circumstances, including but not limited to weather conditions, insufficient numbers, or other safety concerns. In such cases, you will be offered an alternative date or a full refund.
2.3. Changes by You: If you wish to make changes to your booking, please contact us as soon as possible. Changes are subject to availability and may incur an additional cost e.g. adding additional members to the group.
3. Health and Fitness
3.1. Fitness Level: Participants must ensure they have the appropriate level of fitness for the chosen hike. Please consult the hike descriptions for specific requirements.
3.2. Medical Conditions: It is your responsibility to inform us of any medical conditions or special requirements at the time of booking. We reserve the right to decline a booking if we believe it may compromise the safety of the participant or the group.
4. Safety and Conduct
4.1. Guidelines: Participants must follow the safety guidelines and instructions provided by the guide at all times.
4.2. Conduct: We expect all participants to conduct themselves in a respectful and responsible manner. We reserve the right to remove any participant who poses a risk to themselves or others.
4.3. Footwear and Equipment: Participants are required to wear appropriate footwear, such as sturdy hiking boots with good ankle support. Failure to wear proper footwear may result in being excluded from the hike.
4.4. Terrain: Participants should be prepared for varying terrain conditions, including but not limited to, rocky paths, steep inclines, and potentially wet and muddy areas. Please ensure you are adequately equipped for these conditions.
5. Changes During the Hike
5.1. Route Changes: Our guides may need to alter the planned route due to weather conditions, trail closures, or other unforeseen circumstances. Any changes will be made with your safety as the primary consideration.
5.2. Duration and Pace: The duration and pace of the hike may vary depending on the group's ability and external conditions. Please be flexible and understanding of any necessary adjustments.
6. Liability
6.1. Insurance: We strongly recommend that all participants take out adequate travel insurance to cover personal injury, medical expenses, and loss of personal belongings.
6.2. Liability: OutdoorsDJ is not liable for any loss, damage, or injury sustained during the hike, except where such loss, damage, or injury is caused by our negligence.
7. Complaints
7.1. Procedure: If you have any complaints during your hike, please inform your guide immediately so we can address the issue promptly. If the matter is not resolved to your satisfaction, please contact me within 14 days of the end of your hike.
8. Photography
8.1. Consent: By participating in our hikes, you consent to the use of any photographs or videos taken during the hike for promotional purposes, unless you notify us otherwise in writing.
9. Governing Law
9.1. Legislation: These terms and conditions are governed by Scottish Law. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Scotland.
10. Amendments
10.1. Changes: We reserve the right to amend these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately.
